为了达到人道主义的目标,"公平劳工标准法案"(Fair Labor Standards Act)设立了关于雇员的加班费,最低工资标准和保存记录的要求。

加班费:雇主应当对公平劳工标准法案保护的未被免除的雇员每周超过40小时后的工作支付不低于其标准工资的1.5倍的工资。以下三种雇员可能被视为被免除的雇员:行政人员,管理人员和职业人员。

最低工资标准:联邦最低工资标准自2008年7月24日起为$6.55每小时,并自2009年7月24日起将升为$7.25每小时。很多州有规定不同于联邦标准的最低工资,如果州和联邦最低工资标准不同,一般以较高的最低工资标准计算。德克萨斯州的最低工资标准与联邦最低工资标准一致。

记录备案:每个雇主都必须用海报张贴公平劳工标准法案基本要求,并且,雇主必须保存员工上班时间和给付工资的记录。
